1. Preliminary

All orders placed through this website by Australian customers will be administered by KAVE HOME’s exclusive Australian distributor, LAGRAND FURNITURE PTY LTD (LAGRAND) subject to these Terms and Conditions.

LAGRAND is registered in Australia as a proprietary limited company under ACN 114 107 390 and ABN 32 114 107 390. Its registered office and principal place of business is at 68 Omrah Avenue, Caloundra, Queensland 4551, Australia.

This portal is owned by KAVE HOME S.L.U (hereinafter, "Kave Home")

With fiscal address in Girona (17410), C/ Tallers, 14.

Tax number (CIF) B-55.159.271

Registered in the Girona Mercantile Registry in Volume 2910, Folio 92, Sheet GI 54360.

It is the responsibility of the user to be aware of these General Terms and Conditions in force when starting the Purchasing process.

Kave Home can modify these Terms and Conditions at any time. Modifications will not affect any purchases made prior to the approval of said modifications, in any case. Purchases will always be governed by the General Conditions in force at the time of making the purchase.

Please, read carefully the information of every product to be aware of their specific conditions, as these Terms and Conditions may be completed or modified by specific clauses or specific conditions of certain products, especially regarding exclusion of rights of withdrawal, changes or refunds.

The electronic document in which the contract is formalized will be archived by LAGRAND and can be consulted through our customer portal with authentication of your username and password or the means established in each case. A paper copy can be requested from Customer Service, info@kavehome.com.au, whose details are outlined in Clause 12 of the Terms and Conditions.

By accepting these conditions, the user declares themselves to be of legal age and have enough legal capacity to be bound by these General Sale Conditions

2. Applicable law

This electronic contract is governed by and will be construed in accordance with the law applicable in New South Wales, Australia and each party to this contract irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of that State .

The current Terms and Conditions may be saved and reproduced at any time by the user making a purchase through the options of their internet browser and must be accepted before proceeding to the payment of the products.

3. Registering as a user

In order to purchase Kave Home products electronically, it is not necessary to register as a user of the page (www.kavehome.com.au). You can make the purchase without registering.

Registration as a user is free and must be done through the "Create an account " tab on the website itself. At the end of the registration process you will receive an email confirming that the process has been completed correctly.

The user can access the section of registered users with their username and password or in other ways which enable Kave Home and LAGRAND to authenticate users. In their profile, the user can find relevant information such as that which is related to previous orders or the shipping address provided.

The user can unsubscribe at any time by sending an email to the address: info@kavehome.com.au . Unsubscribing as a user will imply the cancellation of the user’s personal data.

4. Validity period of the offer

Notwithstanding the provisions of the specific legislation, electronic offers or proposals for sale will be valid for the period established by in the online quote or, failing that, until such time as LAGRAND notifies you otherwise.

5. Purchasing process

The purchasing process is composed of the following steps:

(i) Product selection: Browse our page and click on the "Add to cart" button each time you want to add a product to your order. The shopping cart contains the name of the selected product, the quantity and the price in euros.

(ii) Beginning of the purchasing process: To start the purchase process press the "Checkout" button.

(iii) Completion of the purchase data: Before selecting the payment method, you must complete the details of your purchase and correct any errors in the data entry. Once you have verified your information, confirm your order.

(iv) Selection of payment method: Select your preferred payment method, accept the current General Sale Conditions by checking the corresponding tab and click on the “Finish order” button. At that time, the contract will be completed for all intents and purposes.

(v) Purchase confirmation: Once we receive your approval, LAGRAND will issue a confirmation on screen that you can archive which will contain the following information:

- Order number

- Date of order

- Summary of products included in the order.

In all cases, LAGRAND will issue a confirmation of purchase by email within a maximum period of 24 hours from receipt of the purchase order.

Throughout the purchase process you can consult the Terms and Conditions, as well as see the final price of the selected products.

Once the purchase is confirmed, the customer cannot modify or cancel the order, except as provided by applicable Australian law or in these Terms and Conditions.

6. Price, taxes and shipping charges

All the prices indicated on the website are referred to in Australian Dollars and include any taxes and fees applicable to the Australia, notwithstanding the fact that the purchase of the products from another territory could incur corresponding taxes and/or customs duties. LAGRAND will, using the bank details entered by the user on the website, charge the final amount of the order.

The shipping costs will be detailed at the end of the purchase process, where you can choose the desired shipping method. These shipping costs will be borne by the user in full.

Prior to accepting the price through the “Finish order” option, the user will see the full final price of the order, broken down, if desired, the amount of the additions or discounts applied, as well as transport costs, taxes, customs duties, and other additional services.

Product prices may vary at any time depending on Kave Home’s pricing policy. The products purchased will be billed at the price in effect at the time of purchase.

LAGRAND reserves the right to reject an order where there is a pricing error, without liability to you.

7. Payment

Users may pay the amount of the products purchased by any of the following means:

a) We accept almost all credit and debit cards.

b) Via PayPal.

c) Via bank transfer.

Each of Kave Home and LAGRAND severally guarantees that it will treat the personal data obtained through the registration form filled out by the user with total security and confidentiality in accordance with its privacy policy.

8. Invoice

LAGRAND will send proof of purchase by email to the address provided by the user. Likewise, if the user wants to download the order invoice: the user must log in and access the "My Orders" section within the personal account. Once selected the order for which the user wants the invoice, he should click on the "Download Invoice" button at the bottom.

If the order has been placed as a guest and therefore the user does not have a personal account, the user must create a new account with the same e-mail address with which the order has been placed with and follow the steps explained above.

9. Delivery

Delivery Fees: Delivery fees and times vary for different products and are calculated based on the size and weight of your order and its destination. The delivery price for each order will be displayed during the checkout process, prior to payment and order confirmation and included in the total price of your order. Changes made to delivery address or delivery time after placing an order may incur additional charges, which we reserve the right to request to add to your original delivery charge. Delivery estimates calculated at checkout are based on delivery to the front door of a ground floor. Approval for requests to have items delivered past this point must be requested prior to an order being placed. This is a request and cannot be guaranteed. The request is based on courier availability and payment of this service.

Delivery time: Each product listing includes the estimated dispatch time frame for that product. Typically, items listed on the website will be dispatched from our warehouse within 24 to 72 business hours. In some cases the estimated dispatch time frame will be longer. From time to time the delivery of specific items will exceed our usual stated delivery window for reasons outside our control. We work hard to process all orders as quickly as possible and we will send you an email to let you know when your item has been dispatched by us or if we anticipate delays.

Risk in the products passes to you on commencement of delivery. We do not accept liability for any loss, theft or damage to the products after delivery.

Delivery methods & locations: We work with a number of delivery partners and courier companies in order to deliver nationwide; in some cases this may be handed to a third party to ensure remote areas can be accommodated. Your order will be delivered to the delivery address provided by you during the checkout process or as updated through our customer service team after your order is finalised.

Delivery is to a ground floor; if the delivery is in a multi-story building the delivery company will not travel past the ground floor front door.

For larger high value items, we may be able to offer alternate delivery service, however this is not available for all items and all areas. Our customer service team can confirm if this is available to your order and area, applicable fees and charges will apply for this service.

We cannot deliver to PO boxes or Parcel Lockers because they're usually too small to accept most of the items we sell. Most of our goods are delivered by courier or specialist furniture carrier directly to your door and require a signature upon delivery.

Our delivery partner may leave a card at the address and you will need to pick up the delivery from an Australia Post outlet or contact the courier company to arrange for redelivery.

We reserve the right to refuse delivery to specific locations for items we deem at high risk of loss or damage, and also areas that are inaccessible with standard courier and delivery services. In this case, you may choose to have an item delivered using your own couriers, in which case all insurance for loss or damage to the order caused by the delivery will be your responsibility.

You agree to pay any shipping and handling charges presented to you at the time you make a purchase.

We deliver most products Australia-wide. In some cases, we will only be able to deliver products in metropolitan areas. This information will be shown on the product listing. We are not able to accept orders for international delivery at this time.

Delivery failure: It is important that you verify your information is correct before placing your order, especially your delivery address. If the address provided is incorrect and the package is returned, you will be billed for the additional shipping charges in order for your delivery to reach you. You agree to this by placing an order with us, we reserve the right to pass on applicable charges to you if you provide wrong address information. We also require a contact phone number, which may be used by the courier to arrange delivery. If we and our delivery partner have been unable to deliver your order due to your error or fault after 21 days or 2 attempts (whichever is sooner), we reserve the right to cancel your order. In these circumstances we will refund you the price of your order, less the delivery and handling fees incurred by us.

Missed Deliveries and Rebooking: If any issues are encountered prior to the scheduled delivery on the day, we will endeavour to keep you updated. There can be instances where our drivers will face traffic delays or accidents on the road and this will not allow us to deliver to you as planned. Our Delivery Partner/Customer Service will get in touch with you to confirm an alternative delivery day.

If you are not home to receive a delivery and you have not authorised to leave the package at the door, a card will be left with details to organise an alternative delivery day with our delivery partner. Some delivery partners may not be able to leave a card. In these circumstances our Delivery Partner/Customer Service will get in touch with you to confirm an alternative delivery day.

10. Responsibility for the delivery

Whilst we endeavour to show accurate stock levels at the time you purchase, please be aware stock is not confirmed as available until you receive your invoice.

LAGRAND can't be held responsible for variations in stock levels or stated order ETA's, these can change suddenly and without notice and are often completely beyond our control.

Also, LAGRAND will be released from the fulfillment of its delivery obligations provided in Clause 9 above, and declines all responsibility in this regard, in the following cases:

a) Full or partial non-payment by the user.

b) Omission or inaccuracy of the information that, in accordance with Clauses 3, 5, 6 and 7, the user must provide when placing the order.

11. Returns

30 day returns: We want you to love the products you buy from us. If you change your mind, you may return it to us within 30 days of the date you received it, no questions asked.

You will be responsible for the actual shipping costs to facilitate a change of mind return, irrespective of any free, discounted or any other type of shipping promotion that may have been applicable at the time of your order. This includes the costs of shipping the item to you in the first place and the cost of shipping back to us.

You must lodge a return request via the Kave Home website. Alternatively, you can contact us with your name and order number and our customer service team will arrange the return for you.

Items returned must be in 'as-new' condition and packaged securely in the original packaging. This means you have not used, assembled, damaged, washed or laundered any of the items.

Non-returnable items excluded from all change of mind returns include:

  • Products described as "made to order"
  • Mattresses, bedding, pillows and sofa covers
  • All forms of clearance stock (e.g. warehouse, floor stock etc.)
  • Clearance items
  • Personalised items
  • Gift Cards
  • Orders for commercial or non-domestic use

Within 5 business days of receiving your return, and subject to confirming it is in 'as-new' condition, we will issue you with a store credit voucher via email in an amount equal to the price you paid for the product, less the cost to ship the product to you and the return shipping back to the warehouse. Credits are issued in the form of store credit.

Store credit voucher codes will be valid for one (1) year from the date of issue.

We will not accept returns delivered in person to our depots, or offices or warehouse facilities.

Damaged in transit: Unfortunately items are occasionally damaged in transit.

If an item arrives and the packaging or the item itself is clearly and significantly damaged, you should take photos or video showing the damage, refuse to accept the delivery and contact us immediately. We'll share your feedback with our delivery partners and suppliers to ensure our service and the quality of packaging is improved.

If you notice that an item is damaged after it has been delivered to you, please take photos or video clearly showing the damage and contact us as soon as possible, ideally within 3 business days of receiving your delivery.

The type of remedy we offer will depend upon the circumstances. We will work collaboratively with you to find an outcome that you're happy with. For example we may arrange to:

  • Suggest a self repair (with an offer of compensation to you)
  • Arrange a repair by a local tradesperson in your area
  • Offer a partial or full store credit voucher or refund
  • Replace the product (subject to availability)
  • Arrange for the product to be returned

If we require you to return the product to us, we will pay the cost of the return.

Wrong item delivered: Very occasionally we may accidentally ship the wrong item to you. If you have received an incorrect item, let us know as soon as you can, ideally within 3 business days of receiving your delivery. We will offer to send you the correct item and arrange for the pick up and return of the incorrectly shipped item at no cost to you.

Faults and Warranty Claims: LAGRAND warrants all goods to be free from defects in materials and workmanship, and of acceptable quality and durability for the purpose for which they are designed. Warranties and guarantees are provided in accordance with Australian Consumer Law.

If an item arrives that is missing parts, is faulty, is defective or has been damaged during manufacturing, please take photos or video clearly illustrating the problem and contact us as soon as possible, ideally within 3 business days of receiving your delivery.

The best solution to any product fault depends on the nature of the fault itself, and the outcome that works best for you. We will work collaboratively with you to find a solution that you're happy with. For example we may arrange one or a combination of the following:

  • Send you any missing parts or components
  • Suggest a method self repair (with an offer of compensation to you)
  • Arrange a repair by a local tradesperson in your area
  • Replace the product (subject to availability)
  • Offer you an alternative product
  • Offer a partial or full store credit voucher or refund

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.

This Faults and Warranties policy does not cover:

  • Normal wear and tear
  • Damage arising from improper assembly or modification
  • Damage arising from abnormal use or abuse
  • Damage, wear and tear as a result of improper or lack of maintenance and/or care (e.g. fabric, leather or timber)
  • Damage to external or product packaging only
  • Damage occuring during your own handling and transportation of goods from a Click & Collect pick up location
  • Insignificant minor variations in dimensions, colour, grain or finish
  • Insignificant minor imperfections or superficial blemishes

13. Warranty

Our Goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage directly resulting from a breach of warranty by LAGRAND. You are also entitled to have any defective product repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

All our products are guaranteed to be free of manufacturing defects for 2 years from the date of purchase, except for those which have an express lesser warranty period.

The warranty is expressly invalid in the following cases:

a) Transport, accidents, improper uses, and other damages not due to the normal use of the product by the customer once the goods are delivered. This guarantee only covers transport damages caused before the material is received.

b) Shipping of the product without the original packaging.

c) Burns, cuts, scuffs, creases, marks, scratches or other damage caused by animals or by improper use of the product.

d) Use or contact with chemical products (acids, solvents, dyes, paint, ammonia, lacquers or other hairdressing products...), treatment with cleaning products not indicated for the specific upholstery of the guaranteed product.

e) Colour deterioration due to exposure of the product to solar rays or other sources of heat.

f) Indirect damage and loss of any kind.

g) Personal and/or material damage, caused as a result of non-compliance by the user of the rules and instructions given by Kave Home for the installation, use and maintenance of the product.

h) If you alter or repair the product without the express prior written approval of LAGRAND.

14. Force majeure

LAGRAND will not be liable for the total or partial non-compliance with the obligations arising from this contract or for the delay in carrying them out if said breach is due to a circumstance of force majeure, including strikes, flood, fire, pandemic, internet failure, etc.

15. Personal data protection

Your personal information you provide us will be processed in accordance with our privacy policy.

16. Intelectual property

Kave Home will retain all intellectual and industrial property rights in the products and website content, including rights to business secrets, relating to all blueprints, rules, paintings, diagrams, graphic material, photographs, design samples and other documents, either in electronic media, printed form, as pre-printing material or brochures that will be delivered to the user in the context of the manufacture, test, demonstration and commercialization of his products.

17. General provisions

If a provision of these Terms and Conditions is invalid, illegal or unenforceable, then to the extent of the invalidity, illegality or unenforceability, that provision must be ignored in the interpretation of these Terms and conditions. All other provisions of these Terms and Conditions remain in full force and effect.

No failure to exercise or any delay in exercising any right, power or remedy by a party operates as a waiver. A single or partial exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding on the party granting the waiver unless it is made in writing.

The contract established from these Terms and Conditions constitutes the entire agreement between the parties and supersedes all prior representations, agreements, statements and understandings, whether verbal or in writing.
